Rather common these days, unfortunately. Study for a degree or whatever, sue the institution if you don't pass. If you don't pass, then you don't meet the minimum standard - end of story. Those who failed in the past, do it again, put in extra effort - and pass the next time. Usually.
Smoke makes things work. When the smoke gets out, it stops!
